Alla Polanco’s Terms of Service for Private Commissions
General Terms
Prices are subject to change based on demand and availability. I reserve the right to refuse any order for any reason.
All commissions will contain my logo and signature in a non-intrusive way unless otherwise arranged.
I might record the drawing process and post it to my YouTube channel.
NFT usage is strictly forbidden.
My art is not to be fed to any A.I. art software/algorithm.
License & Copyright
I, Andres Polanco, the artist:
Will grant you a non-commercial, perpetual and worldwide license to use and display the Final illustration in digital or print mediums.
I reserve the right to cancel and refund the order at any time for any reason.
I will NOT claim the Intellectual Property (IP) of any of your commissioned original characters and designs.
I will NOT further profit from any commissioned artwork that contains your IP.
I retain all rights not expressly granted by these Terms of Service. Any use additional to that expressly granted requires arrangement for payment of a separate fee.
You, the client:
May NOT use the commissioned artwork for commercial purposes.
You have the right to upload, share and display the commissioned artwork on any website and social media as long as it’s not for commercial purposes and you properly credit me as the author. Displaying the commissioned images during your monetized live streaming or videos is allowed as long as the illustration is not the main subject for the earnings. You can also have a copy of the illustration printed and display it on your wall. If you are unsure whether your intended use for the image is commercial or not, ask me.
You don’t own the copyright of the artwork, therefore, you may NOT claim it as your own or make profits from the commissioned piece (reselling, redistributing, publishing, uploading to print-on-demand services, etc.)
You may NOT change, create derivative works or extract portions of the delivered illustration without my explicit consent.
You retain the rights to the intellectual property (IP) of your own original characters and designs depicted in the illustration.
Any grant of rights is contingent upon receipt of payment in full for the Final Illustration.
Payment
Only currency I manage is United States Dollars (USD). Payment must be done via PayPal and is subject to their currency exchange rate.
At least 50% of payment is due before any work can begin. Payment in full is due when final sketch is approved.
Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.
Process & Revisions
After payment is done, I will ask for a few more details and start working on your piece, you can prepare in advance to provide me with those details if you read my FAQ section. Make sure you are very clear when describing what you want, and that the references are also very clear.
I will send a few sketches for you to review, at which point you may ask for up to 3 changes free of charge on the sketch or sketches of your choice. Any further changes come at an additional small fee depending on the complexity of the changes. Once we settle on a final sketch, I will proceed to render the illustration, at which point, no more changes are allowed so make sure the final sketch accurately represents what you want in your commission. If the changes are due to a misunderstanding on my part, no fee will be charged, but if your references and descriptions were not clear to begin with, changes will come at a fee.
I will ask if you have any preferences in mind for the color scheme and mood of the piece, but I will usually make my own recommendations. Up from this point, the rendering process may take somewhere between 1 to 8 weeks, depending on complexity and how much additional work I have at the time, I might contact you during this time if I need to clarify or ask for additional details. You may also request WIPs during this time, if you so wish. I will contact you again once I am done with your commission and send you the final illustration.
Final illustration will be delivered as a full resolution PNG file. If your commission was for an emote, I will send you up to three files in three different resolutions depending on your needs.
Cancellations & Refunds
No refunds will be issued once I have started working on the artwork, but if you cancel your order before I started working on it, you can get a full refund.
If for any reason, I become unable to complete your commission, you will receive a full refund.
If you are getting a refund, do not request a PayPal chargeback. I will transfer the money back to you myself.
If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply PayPal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.
